Aim of the coursework  

This coursework aims at:

a) Developing an understanding of the nature and types of construction contracts in the UK and

b) Exploring and applying contractual provisions to resolve contractual problems using standard forms of contracts.

 The Assessment covers K1 & K13 (Knowledge competences), and S4 (demonstrate negotiating and problem-solving skills)

Task    

1. Discuss the key defining characteristics of Option A of NEC4 main contract and explain under what circumstances you would recommend this option and why.

2. Two parties have entered an ECC contract, option A, and are experiencing the following issues:

  1. The scope of foundation works has increased due to discovery of previously undetected buried asbestos that require safe removal. In addition, the contractor is required to construct a concrete barrier to prevent further contamination.
  2. Client issued instructions to stop work due to cash flow problems occasioned by late release of funding from loaning institution.

Now assume that the two scenarios (above) took place in Traditional JCT contract with Quantities context. Advise the parties on their entitlement under JCT. Compare and contrast the two processes and outcomes.
